In these Terms of Sale, the following words shall have the meanings set out below:
“Tutto Italiano Limited”or “we” or “our” means Tutto Italiano Limited.
“Contract” means a contract agreed by you and Tutto Italiano Limited on the sale or supply of goods and/or services pursuant to these Terms of Sale.
“Goods and/or services” means any goods or products and/or services offered for sale on this Website from Tutto Italiano Limited.
“Website” or “Site” means www.tuttoitaliano.com.hk and/or www.tuttitaliano.com and/or www.tuttitaliano.it.
“You” means you or any persons who order goods, products and/or services through this Website from Tutto Italiano Limited.
2. THESE TERMS AND CONDITIONS
“Terms of Sale” govern your order and purchase of any goods, products and/or services through this Website. By submitting your order on this Website, you agree to accept these Terms of Sale and to be legally bound by them. If you do not wish to accept these Terms of Sale, please do not submit any order through this Website.
You are advised to check the site from time to time to check the update or changes to the said policies and agreements.
Tutto Italiano Limited attempts to be as accurate as possible in relation to the information and content on the Website. However, Tutto Italiano Limited, to the maximum extent permitted by law, does not warrant or guarantee that the information and content on the Website is accurate, complete, up-to-date or error-free.
2.1 Terms and Conditions – Italian Language Lesson
2.1.1 Being late for lessons
You must be on time for your lessons.
Your teacher will wait for you for a maximum of 15 minutes.
If you have not arrived in 15 minutes, your lesson is cancelled and you will lose it from your package.
2.1.2 Cancellation policy
You can cancel or reschedule a lesson but you must cancel it 24 hours before your next class. (Hong Kong time zone; GMT +8).
If you cancel the lesson on the same day of the class, then you will lose it from your package.
This rule is applied even if you are ill or because of a situation you have no control over.
With Tutto Italiano you can only cancel two classes per month.
As of the third class, no reimbursement of lessons fee will be provided.
2.1.3 Sharing lessons
When you buy a package of lessons, they are for yourself only.
This means it will not be possible to share lessons you have purchased with other people such as friends or family members.
Lessons are based on you and not on your friends or family members.
If any other persons want to take lessons, they will have to make a purchase for themselves.
Any change must be reported at least 24 hour before the class (please see Cancellation policy).
2.1.4 Completion time for lesson packages
Tutto Italiano lesson packages must be completed in a certain time period.
If you buy a 4 lesson package, you must finish all of your lessons in a one-month time period starting from the date of the first lesson (i.e. minimum of one lesson per week).
If you buy an 8 lesson package, you must finish all of your lessons in a two-month time period starting from the date of the first lesson (i.e. minimum of one lesson per week).
If you buy a 12 lessons package, you must finish in a three-month time period.
If you buy a 16 lessons package, you must finish in a four-month time period.
If you fail to complete all your lessons within the specified time period, the unused lessons will expire.
2.1.5 Tutto Italiano Limited – cancellation of lessons
The teacher tries to be available for all of lessons 100% of the time, but there are times when personal circumstances mean the teacher must cancel a lesson herself/himself.
You must accept that this can happen even on the same day of the lesson.
When the class is cancelled by Tutto Italiano Limited you can choose to either change the class to another time slot or to receive a full refund.
2.1.6 Studying in a quiet environment
If you are studying at home, please ensure that you have a quiet environment in which you can study Italian.
If it is too noisy around you at home or any other place, the teacher may not be able to work with you.
2.1.7 Termination of lessons
Tutto Italiano Limited sometimes may choose to stop teaching students who are not able to adapt to Tutto Italiano teaching methods or who do not have a mature attitude in learning.
This only happens once a lesson package is completed.
2.2 Terms and conditions – Dermatological and aesthetic consulting
Dermatological counselling is provided after visiting the patient online and therefore with the limits of the method, whether it is a diagnosis made with digital photographs or after direct online consultation (live).
If a diagnosis with photographs is required, more than one must be available, preferably with different distances and good lighting.
In particular, a precise diagnosis cannot be given for skin tumors and other inflammatory skin disorders (skin tumors and inflammatory skin disorders) if you do not have close and enlarged images.
Images obtained with the Fotofinder ® handyscope system can be provided: in this case the images are obtained with a smartphone connected to a lens that is placed on the suspicious lesion or over the skin with a pathology to be defined. In this way, the practitioner is able to provide a much more precise and in-depth diagnosis.
3. INTELLECTUAL PROPERTY
The Tutto Italiano Limited company logo, all software, and content (which is defined as, or includes, any text, audio or music, video, graphics, photographs, and image) are the intellectual property of Tutto Italiano Limited and are protected by intellectual property and copyright laws and international treaty provisions.
5. ELIGIBILITY TO PURCHASE
In order to place orders with us, you must meet our conditions of eligibility:
1. Be aged 18 years of age or over (in particular, under the law of Hong Kong, intoxicating liquor must not be sold or supplied to a minor in the course of business.)
2. Be in possession of a valid credit/debit card issued by a licensed bank acceptable to Tutto Italiano Limited for payment or be in possession of a valid online method of payment acceptable by Tutto Italiano Limited.
All orders are subject to stock availability and confirmation of the order price. Items in your shopping basket are not reserved and may be purchased by other customers.
6. GOODS, PRODUCTS AND/OR SERVICES DESCRIPTIONS
Tutto Italiano Limited will try all the best to ensure that the Contents and the goods or products and/or services descriptions on the Site will be accurate and complete as possible. We however do not warrant that Contents and goods, products and/or services descriptions are accurate, complete, current or error-free.
Wine and food products cannot be returned once purchased.
Tutto Italiano Limited is not responsible for the content itself of other websites presented through related links inside our website.
Tutto Italiano Limited apologises for possible spelling, typing or translation mistakes in the texts and rejects as well any liability for moral and material damages deriving from them.
7. ORDER CONFIRMATION/ACCEPTANCE
After you place an order to purchase goods, products and/or services from Tutto Italiano Limited through the Website, you will receive an e-mail of invoice and delivery note from Tutto Italiano Limited confirming receipt of your order.
This email is only a confirmation of receipt of your order and does not constitute an acceptance of your order.
Your order will be accepted and the contract between you and Tutto Italiano Limited will be completed when we send you an email to confirm the goods and/or products and/or services to be dispatched to you at a designated time or time frame. Only the goods and/or products and/or services listed in the confirmation email are included in the contract formed. All sales contracts are concluded in Hong Kong SAR and are written in English.
Tutto Italiano Limited reserves its right not to accept an order for any reason at its discretion.
If Tutto Italiano Limited declines your order, we will notify you using the e-mail address you provided during your registration onto this Website or by phone within five (5) working days after you placed the order. If payment was made and your order is cancelled, Tutto Italiano Limited will refund the appropriate amount of the charge to you.
If you do not receive any email or phone call from Tutto Italiano Limited informing you the cancellation of your order within three (3) working days after you placed the order, your order is deemed to be accepted by Tutto Italiano Limited.
We accept payments made by PayPal, Visa, MasterCard, American Express or via Bank Transfer.
Payment for the goods, products and/or services shall be made in full before physical delivery of the goods, products and/or services.
Tutto Italiano Limited reserves the right to correct pricing errors that may inadvertently occur. In the event of a pricing error, we will notify you of the error and allow you to either proceed with the transaction at the correct price or cancel your order at no cost to you.
You hereby represent and warrant that you are the legitimate holder or authorized user of the credit card that you use for payment of the goods, products and/or services.
9. TITLE AND RISK
Title to goods, products and/or services passes to you when we receive your full payment. Risk of loss of goods, products and/or services passes to you when the goods and/or products is/are delivered to your designated location and/or services to be dispatched to you at a designated time or time frame.
Total liability of Tutto Italiano Limited shall not exceed the total price paid by you for such goods, products and/or services.
Neither party shall be liable to the other party for any indirect, incidental, special, consequential damages or any loss of business or profits arising out of or in connection with your purchase, use or performance of the goods, products and/or services.
Nothing in these Terms of Sale shall limit or exclude either party’s liability to the other arising in respect of (i) fraud; (ii) death or personal injury arising from negligence; or (iii) any other liability which cannot be so limited or excluded under applicable laws.
Prices are shown on the Site are in Hong Kong Dollars (HKD) on tuttoitaliano.com.hk, in EURO on tuttitaliano.it and tuttitaliano.com. Prices displayed on the Site at the time your order is accepted will be honoured except in the case of obvious error. We use our best to ensure that all prices appearing on the Site are accurate, we do not guarantee that they are error-free and reserve our right to rectify any errors. If we discover an error in the price of any goods, products and/or services that you have ordered, we will inform you as soon as possible and offer you the option of reconfirming or cancelling your order. If we are unable to contact you, we will treat the order as cancelled.
If your credit/debit card is not denominated in Hong Kong Dollars (HKD), the final price charged in your currency will be calculated by your issuing bank in accordance with the applicable exchange rate on the day your card issuer processes the transaction.
The cost of each shipment must be added to the individual price of the goods and/or products, the amount will vary depending on shipment and payment, and in relation to country of destination. The total amount for the goods and/or products selected will be clearly stated and communicated to you, before the conclusion of the “Terms of Sale”.
Prices listed on the site are subject to variations and/or change by Tutto Italiano Limited without any prior notice to you. Such increases may depend by the suppliers of Tutto Italiano Limited. “Terms of Sale” concluded prior to the publication of these changes, but not already shipped, will apply the prices prevailing at the time of receipt of the Order.
12. SHIPPING POLICY AND DELIVERY
12.1 Shipping policy
Currently we ship all around the world. Every single products can be shipped in different countries.
You will be given an indication of the expected delivery time when you place your order online. Tutto Italiano’s teams will try their best to meet these estimates but we cannot guarantee that such estimates must be respected.
When you decide to make an online order, at the end you will have the final price with the shipping costs, and in case, tax and duties.
Shipping cost will always be recorded by regular invoice.
All orders placed on the Website are subject to product availability and will be delivered according to our shipping policies.
Tutto Italiano Limited will use all the best to deliver the goods to you on the delivery date that we notify to you. Since the actual delivery of your order can be impacted by many events beyond our control once it leaves our facilities, we shall not be liable for any delay in delivery of the goods.
13. DEFECTIVE GOODS / DAMAGED SHIPPING
13.1 In case of defective goods
The defective goods can be returned to the sender of the delivered parcel, i.e. Tutto Italiano Limited or the supplier of the product, within 7 days from the delivery.
Shipping and packing charges for the return of the delivered parcel are to be paid by you.
The defective goods will be replaced and sent back or else refunded (in case they are sold out) at the expenses of Tutto Italiano Limited.
13.2 In case of damaged shipping
If you receive parcels from Tutto Italiano Limited or the supplier of the product visibly damaged by courier, (packing broken) or visibly stained by the leakage (in case of food or wine products), the damaged parcel can be returned to the sender of the delivered parcel.
You shall examine the products that you purchased and notify us by email, at firstname.lastname@example.org, any defects or damage or problems, within seven (7) days from the date which the products are delivered to you.
Subject to the terms and conditions of this return policy, we will exchange or refund, at our discretion. In that case, you have to send us the products in original boxes with all original packaging materials.
Tutto Italiano reserves the right to charge a fee if any of the original materials is missing and will refuse the return if products are not in the original condition.
In case when the product broken or damaged is out of stock, you will be contacted for a possible replacement. If you will not find in our catalogue for replacement of the product broken or damaged, Tutto Italiano Limited will refund you the amount paid.
The shipping cost of the return of damaged shipping and restitution will be borne entirely by us.
For wine and food products cannot be returned once purchased.
All Goods include the Standard Warranty in accordance with Hong Kong SAR law and with all applicable laws.
17. GOVERNING LAW
These Terms and Conidtions, together with all our policies and procedures, are governed by and construed in accordance with the laws of Hong Kong. The relevant courts of Hong Kong SAR will have exclusive jurisdiction in the event of any dispute or claim associated with these Terms and Conditions.
18. CHANGES OF THE TERMS AND CONDITIONS
Tutto Italiano Limited reserves the right to modify and change the Terms and Conditions at any time. Any changes to this policy will be published on our site.
